The Galt Wins !  The Galt Loses !

That's right, could it be any more unbelievable than this?   My attorney is shocked.  The ICT (Thailand's Ministry of Information Technology) is livid.  The judges in this case decided to split the charges into two parts.   They say for publishing criticism on the Internet, I am Not Guilty.   They say for slandering of a Thai company, I am Guilty.

Imagine that.... I'm guilty of slander but of no way of distributing it.   I was specifically charged with a computer based crime, but the computer was cleared.   I was not.   Staggers the imagination.   One of the local police officers talked to my interpreter saying he would not know how to impose the penalty of the law because in slander cases the authorities typically confiscate the materials that were used to create the slander.   But, in this case, he said this procedure could not be applied.

Has anyone ever heard of a precedent where a judge can alter the charges as they please?   I have never heard of it.  My lawyer has never heard of it.  If the charges are changed, then I must be allow to defend myself differently as appropriate.

The effect of this split is that they have rendered the real law useless.   I am told that ICT immediately called the judges and that ICT is on the war path because this back-door / end-around manipulation of the law is going to have significant repercussions in a handful of other cases already in progress elsewhere in the kingdom.

As for this case, we will appeal.  We have very significant grounds for appeal.   Ultimately, I will win out for other reasons that relate the Clayton's false testimony in court (which, I viewed as being very self-evident as he presented it).

Here is another very scary concept..... The law in this case was very very clear.   The judges simply have decided not to follow it.  Can there be anything more destructive to a society than this?

I was stunned in the court room today.   I really was.  Clayton would have reveled in it if he or his lawyer would have shown up for the verdict.

The judges also changed the penalty for this crime.   Typically the law states that jail time is the appropriate punishment.   A fine was levied against me for 100k baht (about $2,500 USD).  I assume this is an award for Clayton.

Oh, people I'd like to give this topic a better treatment and tell you the whole story blow by blow, but I'm still knee deep in work.  The LED industry is really starting to take off and I couldn't be happier about my business prospects.   So, I'll try to pull away when I can to write up the story on case when possible.
